Early Years settings cannot legally refuse a child with Special Education Needs and Disabilities (SEND). All early years settings must make reasonable adjustments to support children with SEN and cannot deny them access to childcare based on their needs.

How do I find the right setting?

You may want your child to attend an early years setting, but feel worried about how they will manage due to concerns about their learning and development. Once you've chosen your preferred setting, reach out to them and investigate what they are doing for SEND. You can do this by checking their website, reviewing their SEND policies, visiting the school/nursery/childminders, asking questions, and sharing your concerns. The SENCo/Keyworker will be able to reassure you, and suggest ways of supporting your child to attend.

SEND support in Early Years settings

The SEND Code of Practice outlines a Graduated Response to meeting children’s needs that will be followed by settings/nurseries.

The Graduated Response approach should be led and co-ordinated by the setting SENCo/keyworker working with and supporting individual practitioners in the settings and informed by the EYFS materials.
